However, in comments to the above there were a number of people indicating that the "new fees" seem quite reasonable to them.... hook, line, sinker. Amazing. You don't need to catch the smart ones if you can catch the dumb ones and then atrophy the non-compliance pool down to something you CAN (attempt to) prosecute. The point of course is not legality, but how you can spook as many people as possible into complying.

Okay, I see your point: There may be enough doffies out there who buy into the scheme for it to work, or at least to make the remaining non-payer fraction a manageable problem. If that’s what the intention is, it’s a virtual certainty that the reduced rates will be tied to also getting e-tagged. Then again, SANRAL/ETC tried a similar thing before with their “Less 60” campaign, where you could clear your e-tolls “debt” by paying only 40% of its face value, provided that you also got an e-tag. Only a few tens of thousand out of around two million motorists accepted the offer, which ultimately turned into (yet another) abject failure.

An important point to remember in this context is that e-toll “debt” older than three years and about which the motorist has done nothing, has prescribed. That is, motorists who are thinking of accepting this latest offer should make it clear that they’ll only do so if their prescribed e-toll “debt” is also erased.
